Welcome to Crushbit. These Terms of Service ("Terms") govern your use of the Crushbit mobile application and related services (collectively, the "Service") operated by Soliton Group LLC ("Company," "we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not create an account or use the Service.
1. Eligibility
Crushbit is an adult service. To use Crushbit, you must:
- Be at least 18 years old (required by law for adult dating services)
- Be legally able to enter into a binding contract
- Not be prohibited from using the App under applicable law
- Not have been previously banned from the App
- Provide accurate and truthful information
2. Your Account
2.1 Account Creation
You must provide accurate information about yourself when creating your account. Certain verification steps may be required to access in-app features.
2.2 One Account Per Person
You may only create one account. We may terminate duplicate accounts. If you have trouble accessing your account, contact us.
2.3 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. Notify us immediately if you suspect unauthorized access.
3. How Crushbit Works
3.1 Game-Based Matching
Crushbit is a game-first dating app. There's no swiping or browsing profiles—instead, you play games with other users and the system evaluates compatibility based on game-specific logic.
Any "compatibility," "match," "100%," hearts, or similar indicators are game results derived from gameplay. They do not guarantee any particular outcome, including but not limited to real-world chemistry, shared values, relationship outcomes, or safety.
3.2 Liveness and Photo Verification
Before you can upload photos, your account must pass video liveness verification. This is a Service abuse prevention measure. By completing verification, you consent to the collection, storage, and processing of biometric data (facial geometry) to verify liveness and to check uploaded photos. This data is not sold or shared for unrelated purposes. See our Privacy Policy for retention details.
Liveness verification confirms a live person completed the check; photo verification checks if uploaded photos match liveness data. Neither verifies identity, background, safety, or profile accuracy.
3.3 Your Profile
You create your profile by providing information about yourself and photos of yourself that you have the right to use. This information may be displayed to other users. In-app profile requirements and available preference options may change over time.
3.4 Matching
Crushbit does not "recommend" or endorse users. "Matching" means entering games with other users. Outcomes vary by game mode and may depend on preferences, availability, or gameplay.
User-provided information may be inaccurate or unverified. Choosing to chat (and choosing to meet) is always your decision.
3.5 Location
You select your city or area for matching purposes. We use this to show you matches within your preferred distance. We do not use GPS tracking or precise location data.
4. User Conduct
4.1 You Agree To:
- Provide accurate information
- Use the App only for personal, non-commercial purposes
- Comply with our Acceptable Use Policy
- Use the Block and Report tools when you want to end an interaction
4.2 Legal and Service Provider Requirements
Applicable law and service provider policies (Apple App Store, Google Play) restrict certain content and conduct. Our Acceptable Use Policy details these restrictions. Violations may result in content removal or account action to maintain compliance.
4.3 Profile Visibility & Reporting
By using the Service, your profile information (including preferences) may be used for matchmaking purposes, and your profile and photos may be displayed to other users as part of gameplay and other user-to-user interactions.
Other users may block or report you for any reason. Blocks and reports may automatically trigger account restrictions or termination.
5. Content and Enforcement
5.1 Profile and Photo Review
Uploaded photos are checked against data from your liveness verification and scanned using third-party services for compliance with legal requirements (such as CSAM detection) and app store content policies. This scanning is for legal and platform compliance, not user safety screening. These tools are limited to compliance categories and do not evaluate user intent, credibility, or real-world safety.
5.2 Block and Report Tools
The Service provides Block and Report features. Blocking prevents that account from interacting with you, but may not prevent the same individual from contacting you outside the Service or through a new account.
Reports are processed using automated systems and, in some cases, limited human review of Service-accessible information (such as profile content and account metadata). We do not review or adjudicate private message contents.
If you believe a user has engaged in criminal activity, please contact local law enforcement directly.
5.3 Contract Compliance
We may restrict features, suspend accounts, or terminate accounts to enforce these Terms and our Acceptable Use Policy, based on automated signals (such as repeated blocks or reports) rather than discretionary review.
Accounts may also be restricted or terminated as required by law, regulation, or service provider policies.
We do not resolve user-to-user disputes or determine "who was right," and we cannot verify claims about encrypted message content.
5.4 Content Scanning
App store policies require filtering objectionable material. We use third-party content detection services (including hash-matching and machine-learning based tools) to scan profile media (profile photos and liveness verification video) to remain compliant and to keep operating on these distribution platforms. If CSAM is detected, federal law requires reporting to authorities. Private messages are end-to-end encrypted and cannot be scanned.
5.5 System Design Disclaimer
Compliance services, service-integrity systems, and app features (including profile options) are provided for service functionality. They are not:
- Editorial judgments about acceptable speech or content
- Value judgments about any identity, group, or characteristic
Eligibility requirements (such as minimum age) are determined by applicable law for adult services. All users who meet legal eligibility requirements may use the service.
5.6 Law Enforcement Cooperation
Crushbit cooperates with valid law enforcement requests. While we cannot produce encrypted message content, we may preserve and produce other available information in response to valid legal process.
6. Messaging
6.1 Match Messaging
You can message users you have matched with. Messaging is unlocked when both users express mutual interest after a game.
6.2 Message Retention
Messages may be stored on our servers in encrypted form to enable delivery across devices and sessions. Because chats are end-to-end encrypted, we cannot access the contents of private messages.
You can delete conversations from your account at any time.
7. Subscriptions and Payments
7.1 Free and Paid Features
Some features of Crushbit require a paid subscription. Pricing and features are displayed in the App.
7.2 Billing
Subscriptions are billed through Apple App Store or Google Play Store. Billing terms are governed by those platforms.
7.3 Cancellation
You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.
7.4 Refunds
Refunds are handled according to Apple and Google's refund policies. We do not provide direct refunds. For billing issues, contact Apple or Google through your device's app store.
8. Intellectual Property
8.1 Our Content
The App, including its design, features, and content, is owned by Soliton Group LLC and protected by intellectual property laws. You may not copy, modify, or distribute our content without permission.
8.2 Your Content
You retain ownership of content you upload and represent that you have the right to use and share it. You grant us a limited license to host, process, and display your profile content within the App as necessary to operate the Service.
For messages, you grant us a limited license to transmit and store messages in encrypted form solely for message delivery and synchronization; we do not need (and do not claim) a license to read or publicly display private message contents.
8.3 Feedback
If you provide feedback or suggestions, we may use them without obligation to you.
8.4 Copyright Policy (DMCA)
Copyright complaints should be submitted to dmca@crushbit.app or via the contact form (select "Copyright/DMCA"). See our full DMCA Policy. We terminate accounts of users who are repeat infringers in appropriate circumstances.
9. Disclaimers
9.1 No Guarantees
We do not guarantee:
- That you will find a match or relationship
- That game results reflect real-world compatibility
- The accuracy of user-provided information
- The safety of interactions with other users
- Uninterrupted or error-free service
9.2 User Interactions and Responsibility
We are not responsible for the conduct of users on or off the App. We do not conduct criminal background checks or identity verification.
You control your own safety and interactions through the Block and Report tools. Use caution when choosing to chat or meet in person.
9.3 Profile Accuracy and Limited Verification
Users may misrepresent themselves. Our verification is limited and is not identity verification. We cannot guarantee the accuracy or truthfulness of profile information (including name, age, gender, location, intentions, or preferences).
9.4 Privacy-Preserving Design
Private chats are end-to-end encrypted. We cannot access or monitor message content. By using Crushbit, you acknowledge that this privacy-preserving design is a core feature and that it means we cannot proactively monitor private conversations.
9.5 Game Results Are Entertainment
Game results, scores, compatibility indicators, and similar outputs are arbitrary digital rewards designed for entertainment. They are not indicators of safety, trustworthiness, or real-world compatibility. Do not rely on game results when making decisions about your safety or interactions.
9.6 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
9.7 Limitations of Automated Tools
Our matching and safety features have inherent limitations and do not guarantee any particular outcome or user behavior. Beyond what is required by law, we do not assume a duty to screen, vet, or monitor users. We are not liable for any failure to identify or prevent harmful conduct, except to the extent caused by our intentional misconduct.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
- WE ARE NOT LIABLE FOR THE ACTIONS OF OTHER USERS
SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to indemnify and hold harmless Soliton Group LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another person
- Content you upload or share
12. Dispute Resolution
12.1 Informal Resolution
Before filing a formal dispute, contact us. We may attempt to resolve the issue informally.
12.2 Arbitration
Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the AAA Consumer Arbitration Rules. Arbitration shall take place in Cheyenne, Wyoming, or another mutually agreed location.
Opt-Out: You may opt out of this arbitration agreement within 30 days of creating your account by using the opt-out option in the app's Settings.
12.3 Class Action Waiver
YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS AND WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.
12.4 Exceptions
The following disputes are not subject to arbitration:
- Claims in small claims court
- Intellectual property disputes
- Requests for injunctive relief
13. Termination
13.1 By You
You may delete your account at any time through the App or by submitting a request.
13.2 By Us
We may suspend or terminate your account for reasons including:
- Violation of these Terms or our Acceptable Use Policy
- Fraudulent or illegal activity
- Repeated blocks or reports from other users
- Compliance with legal or service provider requirements
- Extended inactivity
Enforcement is based on automated signals rather than discretionary review. If you believe your account was terminated in error, you may contact us to request review. We are not obligated to restore accounts or provide detailed explanations.
13.3 Effect of Termination
Upon termination:
- Your access to the App will end
- Your profile will no longer be visible, and we may delete or anonymize account data; we may retain certain information as required by law, for safety, fraud prevention, dispute resolution, or enforcement
- Termination does not entitle you to a refund
- Terminated users are not eligible to create new accounts
- These Terms will no longer apply, except for provisions that survive termination
14. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes through the App or by email. Your continued use of the App after changes constitutes acceptance.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding the App.
15.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
15.3 No Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
15.4 Assignment
You may not assign your rights under these Terms. We may assign our rights to any successor or affiliate.
15.5 Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles.
